In light of the recent Executive Orders removing all diversity, equity, inclusion, and accessibility (“DEIA”) programs and positions at the federal level, we recognize that many people have concerns about being terminated due to a protected class, which includes race, religion, sex, age, or disability. While these Executive Orders are enforceable on the federal government to remove DEIA departments and positions, these Executive Orders do not overrule the longstanding federal civil rights statutes which serve as the foundation to bring employment discrimination claims in the instance of unlawful discrimination.
While Pennsylvania is an at-will employment state, meaning your employer does not need a specific reason to terminate your employment, it is illegal for your employer to terminate your employment due to a protected class, which includes race, religion, sex, age, or disability. It is also illegal for a public employer, such as the government, to terminate your employment due to your political speech or political affiliation when you act as a private citizen, which is protected under the First Amendment.
